OCTOBER 8, 2026 Heard. 2] The grievance of the petitioner is that he was appointed as a Shikshan Sewak. The approval was granted. However, vide the impugned order, the approval has been cancelled on the count that at the time of appointment, the roster was not certified. 3] A copy of the certified roster is annexed as Annexure – 2. The learned A.G.P. does not dispute that Annexure – 2 is a certified roster. 4] The roster is dated 18/2/2011, whereas the appointment was made on 30/3/2011, meaning thereby that at the time of appointment, the certified roster was in place. 5] That being so, the impugned order will be contrary to the factual position, in the sense, the order indicates that at the time of the petitioner’s appointment, the roster was not certified, whereas the fact remains that at the relevant time, the roster was certified. 2026:BHC-NAG:13447-DB 25A-WP-4687-2018 2 6] Accordingly, the petition is allowed. The order dated 22/5/2018 passed by respondent no.3 – Deputy Director of Education, Nagpur Division, Nagpur, is quashed and set aside. 7] The petition is disposed of in above terms. (NIVEDITA P.
