JUSTICE ANANT RAMANATH HEGDE ORAL ORDER This petition is filed under Section 482 of the Bharatiya Nagarika Suraksha Sanhita, 2023 seeking cancellation of the anticipatory bail granted to respondents No.1 and 2. 2. Respondents No.1 and 2 are said to be the father- in-law and mother-in-law, respectively, of the deceased. The case is filed against respondents 1 and 2 and their son for offence under Sections 80(2), 85, 3(5) of Bharatiya Nyaya Sanhita, 2023 and Sections 3 and 4 of Dowry Prohibition Act, 1961. The Trial Court granted anticipatory bail to respondents 1 and 2 in Crl.Misc.No.9360/2024 vide order dated 11.11.2024. 3. Learned HCGP would submit that the offence alleged against respondents No.1 and 2 is serious in nature and the Trial Court could not have granted anticipatory bail in - 3 - HC-KAR NC: 2026:KHC:19329 CRL.P No. 12014 of 2025 favour of respondents No.1 and 2. Thus, he would contend that the order has to be recalled and respondents No.1 and 2 be directed to appear before the Court seeking regular bail. 4. Learned counsel for respondents No.1 and 2 would submit that the anticipatory bail is granted on 11.11.2024 on certain conditions and respondents No.1 and 2 have co-operated with the investigation. The investigation is already over and charge sheet is filed and main accused i.e., son of respondents No.1 and 2 is already granted regular bail and no application is filed to cancel the said regular bail granted to the son of respondents No.1 and 2. Thus, he would urge that the petition be dismissed. 5. The Court has considered the contentions raised at the Bar and perused the records. 6. It is evident that anticipatory bail is granted to mother-in-law and father-in-law of deceased in Crl.Misc.No.9360/2024. It is not the case of the State that respondents No.1 and 2 have violated the terms and conditions of bail. - 4 - HC-KAR NC: 2026:KHC:19329 CRL.P No. 12014 of 2025 7. Apart from that, admittedly, the investigation is over and charge sheet is filed and it is to be noticed that the main accused is already granted regular bail. 8. This being the position, this Court is of the view that no case is made out for cancellation of anticipatory bail granted in favour of respondents 1 and 2. 9.
