1. The petitioner has filed this writ petition seeking following reliefs:-
2
“10.1 That, the Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus directing the respondents to grant the petitioner the First, Second and Third Time-Bound Pay Scales with effect from the respective due dates (after 10, 20, and 30 years of service), based on his service book and completed service period, within a time-bound period of 3 months. 10.2 That, the Hon'ble Court may kindly be pleased to direct the respondents to calculate and pay all arrears arising from the grant of the aforesaid time-bound pay scales, along with interest @ 12% per annum from the due dates till the date of actual payment. 10.3 That, the Hon'ble Court may kindly be pleased to direct the respondents to revise the petitioner's pension and other retirement benefits accordingly, incorporating the time-bound pay scales, and release any differential amounts with interest. 10.4 That, this Hon'ble Court may kindly be pleased to grant any other relief, as it may deems fit and appropriate.”
2. Learned counsel for the petitioner submits that the petitioner after serving about 34 years, upon attaining age of superannuation retired from service with effect from 31.08.2023. During his service period, petitioner was not given benefit of time pay-scale and therefore, petitioner submitted representation before the authorities in the year 2023, however, till date no final decision has been taken on his representation by the respondent authorities. He contended that the respondent authorities have found substance on the claim of the petitioner and therefore, they took initiative to collect service record of the petitioner. Respondent No. 2 directed the authority concerned to consider, service record of the petitioner and take necessary steps and instead of perusing the service record available in the office, concerned authority had asked the petitioner to submit service records which is highly arbitrary. 3. On the other hand, learned counsel for the Respondents/State would submit that pursuant to the order passed by this Court, she has sought information from the Chief Executive Officer, Janpad Panchayat – Saja, District – Bemetara and according to her instructions, the concerned
3 authority is taking necessary steps for considering and finalizing the claim of the petitioner. However, she submits that for this, sometime is prayed for. 4.
I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, without entering into the merits of the claim of petitioner, this writ petition at this stage is disposed of with a direction to the Respondent No. 5 to take decision on the pending claim of the petitioner in accordance with law, expeditiously, preferably within a period of 02 months from the date of receipt of order. 6.
