CORAM:
HON’BLE THE CHIEF JUSTICE
--------- For the Appellant: None
--------- 03/Dated: 12.06.2026
1. This is a case where the appellant has abused the process of this Court.
2. Firstly, the record indicates that the appeal was filed and that the objections were not being cleared, despite notification. The record shows that, despite the Advocates for the appellant not appearing before the Registrar (Judicial) on 17.07.2025 and 14.08.2025, opportunities were granted to the appellant to clear the objections from the office. However, the office objections remain unresolved.
3. The matter was nevertheless taken up on 15.05.2026, on which date, notices were issued to the respondents, returnable on 12th of June 2026. Learned counsel for the appellant, on instructions, made a statement that Rs. 3.00 Lakhs would be deposited in this Court within a week from that day. This statement was accepted. Relying on such a statement, the execution proceedings were stayed until the 12th of June 2026. A specific order was passed
Neutral Citation No. 2026:JHHC:17069 p. 2 directing the appellant to take immediate steps for serving notices on the respondents. The matter was placed today to enable the appellant to report compliance.
4. It is now pointed out that no process fees or copies were filed for even serving the notices on the respondents. Besides, most unfortunately, the statement regarding the deposit of Rs. 3.00 Lakhs, based upon which interim relief was virtually snatched from this Court, has been breached. No wonder the learned counsel for the appellant has not even bothered to appear in this matter today. That is why this Court is constrained to record that all this amounts to an abuse of the judicial process.
5. Considering the aforesaid, this appeal and the interim applications therein are dismissed for default. The interim relief was to operate only till the 12th of June 2026, and there is no question of its extension. Nevertheless, it is clarified that the interim relief is vacated.
6. The Registry must immediately communicate this order to the Tribunal/Executing Court by all available means, including email. The Executing Court must proceed with the execution now that there is no pending appeal and, in any event, no interim relief is in force in this matter. The execution proceedings must now be
disposed of within 3 months from the receipt of this order.
7. The appeal is dismissed for default, and the interim applications therein are disposed of.
