07 /09.06.2026: Heard the learned counsel representing the petitioners and the learned counsel representing the respondents.
2. The petitioners in this writ petition has challenged the Circular No. 04/16930 dated 21.09.2016 issued by the Secretary, Department of Revenue, Registration and Land Reforms, Government of Jharkhand. By the said Circular power has been conferred upon the Deputy Commissioner-cum-District Registrar for cancellation/annulment of the sale deeds and in exercise of this power miscellaneous case has been registered. The petitioners also prays to quash the order dated 03.06.2019 passed by the Deputy Commissioner-cum-District Registrar, Hazaribagh.
3.
Learned counsel for the petitioners submits that the said circular was the subject matter of WP(C) No. 3103 of 2020 titled
“Vinod Shankar Jha @ Binod Shankar Jha vs. the State of Jharkhand and Others” and analogous cases wherein the validity of the said Circular was set-aside. He further submits that the Co-ordinate Bench of this Court after considering several judgments and the law has allowed the writ petition and has held that the Registrar has no power to cancel the registered sale deed and the State Government cannot by the executive order confer such power to the Registrar. The said Circular which vests power of cancellation on the Registrar was held bad in law and was set- aside.
4.
Learned counsel appearing on behalf of the State admits that the said Circular has been set-aside by the aforesaid order
2026:JHHC:16536 3
passed in WP(C) No. 3103 of 2020 and analogous cases but submits that against the aforesaid order Letters Patent Appeal being LPA No. 339 of 2024 has been filed and the same is still pending.
5. Considering the submissions of the parties, I find that this case is covered by the judgment passed in WP(C) No. 3103 of 2020 and analogous cases. Since the aforesaid Circular has already been quashed in the batch of cases no further order needs to be passed in this case, so far as this Circular is concerned.
6. Since the aforesaid Circular has already been quashed, the consequential order dated 03.06.2019 stand quashed.
7. This writ petition is allowed in terms of the order passed in WP(C) No. 3103 of 2020 and analogous cases.
8. It is made clear that since the Letters Patent Appeal is already pending, order which will be passed in the Letters Patent Appeal will prevail over this order.
