HON'BLE MR. JUSTICE JASMEET SINGH O R D E R % 21.08.2026
1. This is a writ petition filed under Article 226 of the Constitution of India by six petitioners who appeared in the Re-NEET (UG)- 2026 conducted by the respondent No. 2/ NTA on 21.06.2026, seeking production and inspection of their original, physical OMR answer sheets, carbon copies and other examination records. 2. Mr. Khanna, learned standing counsel for respondent Nos. 2 and 3/ NTA has brought the original OMR sheet along with attendance and calculation sheet as well, copies of which have been given to the petitioners. 3. Mr. Khanna, learned standing counsel further on instructions, states that the carbon copies of the OMR sheet as directed in the order dated 14.08.2026 are not available in view of the fact that the same are kept in the store room and are utilized for administrative purposes. 4. Once the original documents have been brought to the Court for its perusal, the carbon copies are not required. 5. Mr. Khanna, learned standing counsel has relied on the judgment of Hon’ble Supreme Court in Prabhnoor Singh & Ors. v. National Testing Agency & Ors. in W.P.(C) 1286/2021 and more particularly on paragraph No. 10, which reads as under:
“10. For the present purpose, it is not necessary to enquire into the submission of the first respondent that the OMR sheet annexed by the petitioners is fabricated by the petitioners. It is not in dispute that the original OMR sheets of five of the six petitioners have been duly verified. They bear the signatures of the candidates.
In this view of the matter and having due regard to the contents of the counter affidavit, it cannot prima facie be suggested that there was any act of tampering or manipulation in the back office of the National Testing Agency. The examination has been attempted by as many as 15.44 lakhs candidates, out of whom six have come to this Court. Of them, inspection of the originals was permitted to This is a digitally signed order. be taken by all of them and the originals were inspected by five of the candidates on 8 November to 2021.”
6. In view of the judgment of Prabhnoor Singh(Supra), once the original OMR sheets have been perused by the Court, I am not inclined to call for the carbon copy of the OMR sheet. 7. Per contra, Mr. Pathak, learned counsel for the petitioner, states that in the present case, the OMR sheets are not acceptable to the candidates who feel that there has been large scale interpolation. 8. However, since the petitioners are disputing their OMR sheets, I am of the view that the petitioners are at liberty to file a civil suit, which will be adjudicated on its own merit. 9. With these directions, the petition is disposed of. JASMEET SINGH, J AUGUST 21, 2026/sp This is a digitally signed order.
