Learned counsel for the accused-petitioner submitted copy of charge sheet, same is taken on record. It is contended by learned counsel for the petitioner that petitioner has been falsely implicated in this case solely on the basis of disclosure statement of the child in conflict with law. There is no substantive evidence available on the record indicating that the petitioner was responsible in supplying the contraband articles recovered from the possession of child in conflict with law. The charge sheet against the petitioner has already been submitted before the [2026:RJ-JP:4013] (2 of 3) [CRLMB-1686/2026] concerned court, the petitioner is behind the bars since 28.10.2025. There are no cases pending against the accused petitioner of similar nature, further trial of the case may take considerable time, therefore, the second bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of second bail application. It is contended that the accused- petitioner supplied the commercial quantity of smack to child in conflict with law and the child in conflict with law in his disclosure statement has named the present petitioner. The location of the petitioner and the child in conflict with law was found to be at Jaipur-Kota National Highway, which was corroborated through their mobile tower locations, therefore, considering the rider imposed under Section 37 of NDPS Act the second bail application of the petitioner deserves dismissal. 4. Heard and perused the material available on the record. 5. Apart from the mobile tower location there is no other substantive evidence available on record confirming the fact that petitioner has supplied commercial quantity of contraband articles to the child in conflict with law, there are no criminal antecedents of similar nature against the present accused-petitioner, the petitioner is behind the bars since 28.10.2025, therefore, considering the aforesaid facts and without commenting anything on the merits of the case, this Court deems it proper to allow the second bail application of the accused-petitioner. 6. 6. Accordingly, the second bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioner Ramesh Chand Tanwar S/o Shri Motilal Tanwar in connection [2026:RJ-JP:4013] (3 of 3) [CRLMB-1686/2026] with FIR No 758/2025 registered at Police Station Muhana, District Jaipur City South shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
