THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA CIVIL REVISION PETITION NO: 509/2026 ORDER The Civil Revision Petition is filed under Article 227 of the Constitution of India seeking for a direction to the learned VI Additional District Judge, Markapur, Prakasam District for speedy disposal of I.A.No.792 of 2025 in C.F.R(A.S).No.2498 of 2025. 2. Heard learned counsel for the petitioners. As issuance of notices to the respondent is not necessary in this matter, notice to the respondent is hereby dispensed with. Perused the material on record. 3. On hearing, learned counsel for the petitioners submits that the 1st petitioner herein is plaintiff. The plaintiff filed a suit i.e., O.S.No.259 of 2010 for partition and the said suit was dismissed. Aggrieved by the same, the plaintiff intended to prefer an Appeal. Before numbering the said Appeal, the plaintiff died. Then the legal heirs of the plaintiff i.e., petitioner Nos.2 to 5 herein filed an I.A.No.792 of 2025 in C.F.R(A.S).No.2498 of 2025 seeking to condone the delay of one day in preferring the Appeal. He further submits that unless the said interlocutory application is disposed of, the said Appeal cannot be numbered and the interlocutory application filed seeking an interim direction also cannot be numbered and heard. The lower appellate Court ought to have given short date for serving of the notice to the respondents therein. But, without doing so the matter was adjourned from 30.01.2026 to

10.03.2026. In view of dismissal of the Suit, the respondents herein are creating third party interest in respect of the suit schedule properties. If, the lower appellate Court did not dispose of I.A.No.792 of 2025 at the earliest and number the appeal, the rights of the petitioners herein may be deprived. Hence, the learned counsel for the petitioners requests this Court to issue an appropriate direction to the learned VI Additional District Judge, Markapur, Prakasam District for speedy disposal of the I.A.No.792 of 2025 in C.F.R(A.S).No.2498 of 2025. 4.

With the above direction, this Civil Revision Petition is disposed of at the stage of admission. There shall be no order as to costs. As a sequel, miscellaneous applications pending, if any, shall stand closed. _________________________________ VENKATESWARLU NIMMAGADDA, J 02.03.2026 Note: C.C. by one(1) week B/o.BSP/TPS
