In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Nandigram Police Station Case No. 167 of 2025 dated 14.03.2025 under sections 329(4)/137(2)/97/140(2)/61(2) of the BNS, 2023.
And In the matter of : Sanjoy Pati
……Petitioner.
Mr. Amit Ranjan Pati Mr. Sunayan Ghosh Ms. Khadijatul Kubra Ms. Ilika Nag Mr. Avijit Chatterjee Mr. Anish Goswami
……for the Petitioner.
Ms. Sonali Das Ms. Nahid Ahamed
……for the State.
Learned advocate appearing for the petitioner submits that petitioner is in custody for 311 days and the investigation having been concluded and charge sheet have been submitted further detention of the petitioner is unwarranted. Learned advocate for the State has opposed the prayer for bail and produced the case diary. I have taken into account the statement of the victim, the nature of the offence complained of in the statement under Section 183 of the BNSS of the victim which itself reflects the
2 heinousness of the offence, accordingly, at this stage, I am not inclined to release the petitioner, namely, Sanjoy Pati on bail. Thus, CRM (M) 2913 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
