Learned counsel for the petitioner submits that at the time, when the writ petition was filed, the disciplinary proceedings were going on, however, during the pendency of the writ petition, penalty order dated 12.03.2010 has been passed. Although, an application for amendment has been filed by the petitioner, yet as per instructions, learned counsel for the petitioner seeks permission to withdraw the writ petition with liberty to file afresh by challenging the penalty order dated 12.03.2010. 2.
