2. For the reasons stated in the petition, issue notice. 3. Ms. Sachdeva and Ms. Mendiratta, learned counsels accept notice the respondent Nos. 1 and 2, respectively. 4. The brief facts of the case are that as per the petitioner, the petitioner was late in reaching the respondent school on 06.07.2026 and was denied entry. Thereafter, the petitioner was informed that she has been suspended for 1 month. 5.
Subsequently, the petitioner also came to know that her name has been struck of and a Transfer Certificate (“TC”) is to be issued for her. Hence, the present petition. 6. The facts narrated above clearly show that the petitioner did not attend the school on 06.07.2026. 7. Mr. Mittal, learned senior counsel for the respondent No. 2, has handed over an enquiry report which has been perused. It seems that the respondent No. 2 school had taken the said action only as the security and safety of the petitioner is the school’s responsibility. 8. I am of the view that for an absence of one day on account of being late, suspension of one month and thereafter rustication and issuance of TC is disproportionate punishment. 9. For the said reasons, the petitioner shall be permitted to resume her studies in Class XIth at respondent No. 2 school from tomorrow, i.e. This is a digitally signed order.
