As such, Mr. Medhi has contended to grant similar relief to him in the present case also, so that he can apply for regular pre-arrest bail before the court of competent jurisdiction. 4. Per contra, Mr. Borthakur, learned Additional Public Prosecutor, has opposed this application and submits that the applicant has failed to demonstrate extraordinary circumstances, for which he could not apply for regular anticipatory bail application before the court of competent jurisdiction. Under such circumstances, he has contended to dismiss this application. 5. Having heard the submissions of learned counsel for both the parties, this Court has carefully gone through the application as well as the documents placed on record and also perused the notice dated 27.04.2026. 6. It appears that the notice was issued under Section 35(3) of the BNSS asking the applicant to appear before the IO within seven days from the date of receipt of the same. But, the said period already elapsed. 7. However, the applicant has shown the reason, for which he could not appear before the IO and also could not apply for regular anticipatory bail application before the court of competent jurisdiction. 8. Accordingly, taking note of the submissions of learned counsel for both the parties and also considering the nature and gravity of the offence and the punishment prescribed for the same, this Court is inclined to allow this application. 9.
