CORAM :
M.M. NERLIKAR, J.
DATE : OCTOBER 08, 2026. Heard. 2. Issue notice to the Non-applicant, returnable forthwith. 3. Learned A.P.P. waives service of notice on behalf of Non-applicant/State. 4. Apprehending arrest, the applicant has approached this Court in connection with Crime No.617/2026 for the offences punishable under Sections 118(2), 189(1), 189(2), 190, 192, 351(3) and 352 of the Bharatiya Nyaya Sanhita, 2023, registered with Police Station Gondia (City), District Gondia. 5. As per the First Information Report (“FIR”), the informant, namely, Deepak Shobhilal Kansare, aged about 32 years, residing at Lodhitola, Gondia, alleging that on Piyush Mahajan 2026:BHC-NAG:13490
2 9-Cr.ABA-880-2026 07/08/2026, at about 5:00 p.m., when he was present near the house of his friend Gulshan Sulakhe, the accused persons allegedly abused him and his friend's family. It is alleged that the accused, namely, Ritik Thakre assaulted the informant on his head with a stick, whereafter the other accused persons assaulted him. It was further alleged that accused Vikesh Gawarane threw a brick at Gulshan Salunkhe thus he sustained injuries. It was also alleged that accused person namely, Gunjan Thakre has assaulted the informant and abused the family members of his friend. During the incident, Gunjan Thakre is alleged to have exposed his private parts and made a remark that no one could do anything to him. When the informant’s father intervened in an attempt to separate the parties, accused Vikesh Gawarane allegedly threw a brick at him, which hit him on his head and caused an injury. The informant further alleged that the accused persons extended threats of causing harm to him in the future. On the basis of these allegations, the First Information Report (FIR) came to be registered on 08/08/2026. 6. The learned counsel for the applicant invited my attention to the order dated 10/09/2026 passed in Criminal Application [B.A.] No. 768/2026. He submits that the present applicant is also similarly situated and that there is no overt act attributed to him. In fact, in the last paragraph, only his name appears at Serial No. 6. Apart from that, the applicant neither participated in the assault nor assaulted the injured; his presence was only shown. Under such circumstances, he submits Piyush Mahajan
3 9-Cr.ABA-880-2026 that the observations made in the order dated 10/09/2026 would be squarely applicable to the present applicant. 7.
On the other hand, the learned A.P.P. vehemently opposes the application and submits that the presence of the applicant itself is sufficient. Under such circumstances, he prays for rejection of the application. 8. Upon consideration of the submissions of both sides, it is apparent that this Court, vide order dated 10/09/2026 passed in Criminal Application [ABA] No. 768/2026, has granted interim protection to the applicant therein, i.e., Sagar Jaylal Pusam. It is also apparent that, vide order dated 10/09/2026, the said interim order was confirmed, meaning thereby that the applicant therein was granted anticipatory bail. It appears from the record that the case of the present applicant stands on the same footing and, therefore, in my opinion, the reasons recorded in the order dated 10/09/2026 are squarely applicable to the present case. Thus, for the reasons recorded in the order dated 10/09/2026 and the conditions incorporated in the order dated 27/08/2026 in Criminal Application [ABA] No. 768/2026, the present application is also allowed and disposed of. Pending Miscellaneous Application(s), if any, also stand
disposed of.
