1. This petition is filed under Section 11(6) of the arbitration and Conciliation Act, 1996 (for short ‘the Act’) seeking appointment of arbitrator.
2. The brief facts are that an agreement was executed between the parties to the lis on 09.01.2018. The work was to be completed by
18.10.2018. The terms and conditions agreed between the parties provided for dispute resolution through arbitration. The dispute arose between the parties during the execution of the work and the arbitration was invoked under Clause 13 of the agreement by the respondent. The proceedings culminated in award dated 31.05.2025. The award was set aside in a petition filed by the petitioner vide judgement dated 17.11.2025. 2.1 The petitioner thereafter invoked arbitration afresh under Section 21 This is a digitally signed order. of the Act by notice dated 29.11.2025. On failure to do the needful, the present petition is filed.

Learned counsel for the parties are ad idem that the appeal under Section 37 of the Act by the respondent is dismissed on 01.07.2026. The prayer is for appointment of the arbitrator.

Learned counsel for the respondent has no serious objection to the acceptance of the prayer however contention is that there is a joint request that the arbitrator be appointed under the aegis of DIAC.
5. Accordingly, the petition is allowed by appointing Hon’ble Mr. Justice Permod Kohli (Retd.) (Mobile No. 9434721111) as the sole arbitrator for adjudication of the disputes which have arisen between the parties.
6. Arbitral proceedings will be held under the aegis of Delhi International Arbitration Centre (DIAC). Fee of the Arbitrator shall be fixed as per fee schedule.
7. Before entering upon reference, the learned Arbitrator will comply with Section 12 of the Act.
8. It is made clear that since this Court has not expressed any opinion on the merits of the rival claims of the parties and it will be open for the parties to file their respective claims/counter claims before the learned Arbitrator which will be considered in accordance with law.
9. A copy of this order be forwarded to the learned Arbitrator for information.
