[2026:RJ-JP:4429] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 1647/2026 1. Safaruddin S/o Shamshuddin, Aged About 59 Years, R/o Village Hanotiya, Police Station Suket, Tehsil Ramganjmandi, District Kota ( Rajasthan) ( At Present Confined In Central Jail Kota) 2. Nasaruddin S/o Shamshuddin, Aged About 64 Years, R/o Village Hanotiya, Police Station Suket, Tehsil Ramganjmandi, District Kota ( Rajasthan) ( At Present Confined In Central Jail Kota) ----Petitioners Versus State Of Rajasthan, Through P.p. ----Respondent For Petitioner(s) : Mr. Ajay Singh Yaduvanshi For Respondent(s) : Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 30/01/2026 1. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.112/2025 registered at Police Station Suket, District-Kota Rural for offences under Sections 115(2), 126(2) and 189(2) of BNS. 2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. He further submits that only omnibus allegations have been levelled against the present petitioners, and no specific act has been attributed to them. This is a case of free fight in which the complainant party [2026:RJ-JP:4429] (2 of 2) [CRLMB-1647/2026] was the aggressor. A cross-case was also lodged by the petitioner’s side. None of the injuries are reported to be dangerous to life. Co-accused-Monu @ Juber and Tinu @ Sameer have been enlarged on bail by Coordinate Bench of this Court on 03.09.2025, co-accused-Rijwan has been enlarged on bail by Coordinate Bench of this Court on 17.09.2025 and co-accused-Sharukh has been enlarged on bail by this Court on 19.11.2025. Petitioners are behind the bars since 12.01.2026. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, hence on the ground of parity, the bail application of the petitioners may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, and without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioners-Safaruddin S/o Shamshuddin and Nasaruddin S/o Shamshuddin shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/ each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
