JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner – accused is before this Court calling in question proceedings in C.C.No.37730/2022, pending before the Chief Metropolitan Magistrate, Bengaluru, for the offences punishable under Sections 354, 354(b), 323, 504 and 506 of the IPC. 2. Learned counsel for the petitioner and respondent No.2 in unison submit that during the pendency of these proceedings, the parties to the lis have settled their disputes amicably and have filed a compromise petition under Sections - 3 - HC-KAR NC: 2026:KHC:10757 CRL.P No. 10803 of 2023 320 r/w. 528 of the BNSS, 2023 and compromise affidavit before this Court seeking permission to compound the offences. 3. The compromise petition reads as follows: “3. That, the compromise has been entered into voluntarily out of free without any threat, coercion, pressure or undue influence from any person. That both the parties, fully understand the terms of the compromise and are satisfied with the same below mentioned. a. That we are Petitioner and Respondent No.2 in the above mentioned both the cases and we are well acquainted with the facts and we are willing to compromise through this petition. b. Both the parties voluntarily agreed to compromise the matter in the interest of maintaining their respective future lives. c. That compromise has been entered into voluntarily out of free will and consent without any threat, coercion, pressure or undue influence from any person whatsoever. d. That both the parties have mutually agreed not to interfere in each other's personal life in any manner herein after. e. That both the parties undertake to maintain peace and not to initiate any civil or criminal proceedings against each other in respect of the subject matter of present case. f. That compromise is genuine, bonafide and lawful and is not against public policy or morality. g. That this affidavit is filed in support of the compromise petition filed before this Hon'ble Court seeking quashing/ closure of the criminal proceeding in the above mentioned both cases.” - 4 - HC-KAR NC: 2026:KHC:10757 CRL.P No. 10803 of 2023 Though the offences alleged against the petitioners in the case at hand inter alia are the ones punishable under Sections 504 and 506 of the IPC, which are non-cognizable offences, since it is a dispute between the parties and the allegations are not against the State, I deem it appropriate to accept the compromise petition and compromise affidavit and terminate the proceedings against the petitioner. 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed.
