In connection with Chandannagar P.S case no. 0151 of 2025 dated 19/8/2025 under sections 109/115(2)/117(2)/126(2)/3(5)/303(2)/351(2)/352 of the BNS. In the matter of: Amit Roy @ Bhola Ray @ Bhola @ Amit & Anr. ...Petitioners. Mr. Tirupati Mukherjee …for the petitioners. Mr. Debabrata Chatterjee Mr. Santanu Deb Roy …for the State.
1. Learned counsel appearing on behalf of the petitioners submits that there was an altercation between the family members, which led to the injuries on both sides.
2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He relies on the injury report which shows infliction of injuries on three victims. One suffered a grievous injury of fracture which had to be fixed by placing a plate. He also refers to the statements of eye-witnesses.
3. Considering the above and the other materials available in the case diary and the fact that the petitioner no. 2 is a female member of the household, while I am inclined to grant anticipatory bail to the petitioner no. 2 (Pushpa Roy

@ Puspa Ray), the application for anticipatory bail of the petitioner no. 1 is rejected.
4. In the event of arrest, the petitioner no. 2 shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the said petitioner shall cooperate with the investigation and shall not threaten or intimidate the witnesses.
5. Accordingly, the application for anticipatory bail is allowed-in-part.
6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
