JUSTICE ASHOK KUMAR JAIN Order 28/01/2026 1. The second bail application under Section 483 of BNSS is filed by the applicant-accused Vinod Bavriya S/o Shri Roopsingh seeking bail in respect of a criminal case registered as FIR No. 0190/2025 dated 02.06.2025 registered at P.S. Vaishali Nagar District-Jaipur, for the offence under Sections 307, 3(5) of BNS. 2. Learned counsel for the applicant submits that the applicant has been falsely implicated in the matter and the investigation against him is complete and he is no more required in investigation. He further submits that there are no chance of fleeing of applicant accused from the jurisdiction of this Hon’ble Court. He also submits that the [2026:RJ-JP:3996] (2 of 3) [CRLMB-1529/2026] applicant undertakes not to repeat offence and cooperate with investigation/trial, which will take time. 3. Learned counsel for the petitioner submits that the first bail application of the petitioner was dismissed as withdrawn on 25.08.2025, and now the petitioner-accused is in custody as the charge sheet has already been filed against the petitioner. He further submitted that the statements of two witnesses have been recorded by the trial court and, considering the long list of witnesses, the trial will take its own time. He also referred to the order dated 23.01.2026 passed in Bail Application No. 1202/2026, arising out of FIR No. 428/2025 registered at Police Station Mansarovar, Jaipur City (South), and submitted that a Co-ordinate Bench has granted bail to the petitioner despite noticing 29 pending cases. 4. Learned Public Prosecutor has vehemently opposed the bail application and submitted that the allegations are grave and serious in nature. He has also filed a report received from concerned Police Station. 5. Heard learned counsel for the petitioner-accused and learned Public Prosecutor. Perused the material placed on record by both the parties. 6. On the basis of the report dated 02.06.2025 lodged by the victim Jyoti Sharma regarding the snatching of her chain (necklace) by two youths on a motorcycle, FIR No. 190/2025 dated 26.2025 was registered at Police Station Vaishali Nagar under Sections 307 and 3(5) of BNS. After [2026:RJ-JP:3996] (3 of 3) [CRLMB-1529/2026] investigation, the police has already filed a charge sheet against the petitioner. 7. The material on record indicates that a total of 29 criminal cases were registered against the petitioner, and all were of identical nature. The material on record clearly indicates that the petitioner is habitual in committing crimes like the present one. Therefore, this is not a fit case to enlarge the petitioner-accused on bail. 8. The facts and the material indicate that the alleged offence are of serious nature and role attributed to applicant is prima facie sufficient to consider complicity of applicant in the crime. Therefore, at this juncture, considering the evidence collected so far, this is not a fit case to enlarge the applicant accused on bail. 9. Considering the gravity of allegations and overall facts and circumstances of the case, it is appropriate to dismiss the bail application of the applicant accused at this stage. 10. Accordingly, the second bail application filed under Section 483 of BNSS preferred by Vinod Bavriya S/o Shri Roopsingh is hereby dismissed. (ASHOK KUMAR JAIN),J CHETNA BEHRANI /7
