This appeal has been filed by and on behalf of appellant- husband, feeling aggrieved by the judgment dated 01.10.2007 passed in case No.01/2006 by the District Judge, Dholpur, whereby and whereunder a petition under Section 13 of Hindu Marriage Act filed by appellant-husband, was dismissed. 2. Counsel for appellant-husband, at the outset and having instructions from the appellant, states at Bar that during course of this appeal, one another petition before Family Court, Agra for divorce was filed by and on behalf of respondent-wife, and on her prayer, marriage between the parties dated 23.02.1991 has been dissolved vide judgment dated 07.09.2016. The certified copy of the judgment dated 07.09.2016 has been placed on record. 3. In view of the fact that the marriage between parties has already been dissolved vide judgment dated 07.09.2016, it is not required to go into the merits of this appeal. 5.
