JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER The present writ petition is filed by the wife of the victim seeking issuance of a writ of mandamus against - 3 - HC-KAR NC: 2026:KHC:24103 WP No. 13848 of 2026 respondent Nos.1 and 2 to consider and grant premature release of the detenue, who stands convicted for the offence punishable under Section 302 read with Section 34 of the IPC. 2. It is not in dispute that the detenue has undergone incarceration for a period of 14 years, 11 months and 9 days. The detenue has sought premature release, and the Advisory Board, upon reconsideration, has recommended his case for such release. The matter is presently under consideration before respondent No.2 – the Committee. 3. The petitioner places reliance on the order passed by a Co-ordinate Bench of this Court in Sri Ashwatha Narayana Reddy vs. State of Karnataka and others in W.P. No.8787/2026, to contend that in similar circumstances, where the Advisory Board has recommended premature release, this Court has directed - 4 - HC-KAR NC: 2026:KHC:24103 WP No. 13848 of 2026 release of the convict on parole pending consideration by the Life Convicts Release Committee (LCRC). 4. Having regard to the consistent view taken by this Court in similar matters, and taking note of the fact that the Advisory Board has already recommended the case of the detenue for premature release, this Court is of the considered opinion that the petitioner is entitled to limited relief. 5. For the foregoing reasons, this Court proceeds to pass the following; ORDER (i) The writ petition is allowed in part. (ii) Respondent Nos.3 and 4 are directed to release Convict Prisoner No.17865, namely Parvez, on general parole forthwith, subject to terms and conditions as set by the authority, pending consideration and final decision by the Life Convicts Release Committee (LCRC) and the State Government regarding his premature release. - 5 - HC-KAR NC: 2026:KHC:24103 WP No. 13848 of 2026 (iii) It is made clear that the aforesaid release is purely interim in nature and shall be subject to the final outcome of the decision to be taken by the LCRC.
