The petitioner has moved this Court for grant of bail in connection with Senha P.S. Case No.24 of 2024 registered for the offences punishable under sections 302/34 of the Indian Penal Code and under Section 27 of the Arms Act. This is the fourth journey of the petitioner with the prayer for regular bail. The prayer for regular bail of the petitioner was rejected on merit vide order dated 16.09.2025 in B.A. No. 7925 of 2025 and thereafter twice the prayer for regular bail of the petitioner was dismissed as withdrawn. It is next submitted that the co-accused has been granted bail. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. on the other hand vehemently opposes the prayer for bail and submits that the allegation against the co- accused stands on a different footing than that of the petitioner and merely because the petitioner has remained in custody for some time is not a sufficient ground to consider the prayer for bail of the petitioner; which has already been rejected earlier on merit. Hence, it is submitted that the petitioner ought not to be admitted to bail. Considering the serious nature of allegation against the petitioner and the fact that the prayer for regular bail has already been rejected on merit, this Court is of the considered view that the mere fact that the petitioner has remained in custody for some time is not a sufficient ground to admit the petitioner on bail at this stage. Accordingly, the prayer for regular bail of the above-named petitioner is rejected at this stage for the same reasons as mentioned order dated 16.09.2025 in B.A. No. 7925 of 2025.
