Petitioner Represented by Adv. – Mr. Sunit Sahoo -versus- The Collector-cum-District Magistrate, Khurda and others ..... Opposite Parties Represented by Adv. – Mr. Aurobinda Mohanty, ASC CORAM: THE HON’BLE MR. JUSTICE ADITYA KUMAR MOHAPATRA ORDER 12.05.2026 Order No. 01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode). 2. Heard the learned counsel for the Petitioner. Perused the CMP application as well as the prayer made therein. 3. By filing the present CMP application under Article 227 of the Constitution of India, the Plaintiff No.2 in C.S. No.629 of 2023 pending in the court of the learned Civil Judge (Senior Division), Bhubaneswar has approached this Court for a direction to the learned trial court to expedite the trial in the civil suit and dispose of the same in a time bound manner. 4. On perusal of the record, it appears that the suit is of Page 2 of 2. the year 2023. Although the suit has been filed with a prayer for declaration and permanent injunction, however the same is likely to take considerable time to be decided. Further, this Court is also aware of the fact that several year old cases are pending in the civil courts in the State of Odisha. Therefore, it would not be fair to give any specific direction for disposal of the suit of the year 2023. 5. However, taking into consideration the submission made by the learned counsel for the Petitioner, liberty is granted to the Petitioner to move an application before the trial court for early disposal of the aforesaid suit. In such eventuality, the trial court, subject to pendency of the year old cases and its convenience, shall pass necessary orders thereon and, if possible, make every endeavour to dispose of the suit as expeditiously as possible. 6. With the aforesaid observation and direction, the CMP stands disposed of. (Aditya Kumar Mohapatra ) Judge Debasis
