submits that the allegations are there of molestation and in view of that, the prayer for anticipatory bail may kindly be rejected.
5. On query made by the Court, learned counsel for the State fairly submits that the complaint case has been filed on the same facts, which are the subject-matter of the present case.
6. Considering that when the request was made by the petitioner to vacate the land, prima facie it appears that the present case has been lodged and the petitioner is said to be aged about 68 years and on the same facts of the present case, another case being complaint case has been filed. The occurrence is said to be dated 18.03.2026, whereas, the FIR has been lodged on 25.03.2026 and subsequently complaint case has also been filed, which prima facie suggests that the informant is intended to harass the petitioner at any cost and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.
7. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sahibganj in connection with Mirzachowki P.S.
