ORDER 01.07.2026 The learned counsel for the petitioner submits that after filing of the instant petition, the respondent-accused has surrendered before the Superintendent, District Jail, Kupwara in terms of impugned order dated 15th May, 2026. However, the learned counsel further submits that the learned trial court though granted bail to the respondent for a limited time, but without taking into consideration the antecedents of the respondent and heinousness of the crime, therefore, he seeks word of caution, so that in future the bail may not be granted in a routine manner. Since the accused has surrendered before the jail authorities and the Court is not touching upon the merits of the case, therefore, this point is left open to be decided in the appropriate proceedings. Once the accused has surrendered before the jail authorities in terms of the impugned order, there remains nothing for adjudication on merits. Therefore, the petition having been rendered infructuous, the same is accordingly dismissed.
