IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3521] WEDNESDAY, THE ELEVENTH DAY OF FEBRUARY TWO THOUSAND AND TWENTY SIX PRESENT THE HONOURABLE DR JUSTICE Y. LAKSHMANA RAO CRIMINAL PETITION NO: 736/2024 Between: Vallepu Anjaneyulu ...PETITIONER/ACCUSED AND State Of Andhra Pradesh and Others ...RESPONDENT/COMPLAINANT(S) Counsel for the Petitioner/accused:
1. GUNDALA SIVA PRASADA REDDY Counsel for the Respondent/complainant(S):
1. PUBLIC PROSECUTOR (AP) The Court made the following: ORDER:
The Criminal Petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 (for brevity 'the Cr.P.C.,')/Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity 'the BNSS') seeking to quash the proceedings against the Petitioner/Accused No.1 in C.C.No.524 of 2018 on the file of the learned Judicial First Class Magistrate, Addanki registered for the alleged offence punishable under Section 420, 418, 463, 120B, 109 and 464 read with 34 of the Indian Penal Code, 1860 (for brevity
2
the I.P.C') and Section 156(3) of the Criminal Procedure Code, 1973 (for brevity 'the Cr.P.C'). 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. The petitioner is Accused No. 1. A photocopy of the death certificate of L.W.1, N. Seetha, has been filed, which discloses that she died on
24.12.2022. A photocopy of the death certificate of L.W.2 has also been filed, wherein it is stated that he died on 15.08.2023. Further, a photocopy of the death certificate of Accused No. 2 has been filed, which shows that he died on
29.12.2019. 4. L.W.1/Respondent No. 2, the de facto complainant, submitted a complaint before the jurisdictional Magistrate, who in turn directed the Station House Officer of Martur Police Station to register a case. Pursuant thereto, a case in Crime No. 86 of 2016 was registered on 09.07.2016 for the offences punishable under Sections 420, 418, 463, 464, 120-B, and 109 read with Section 34 of the Indian Penal Code, 1860. 5. The allegation against the petitioner and the other accused, as made by L.W.1/Respondent No. 2, is that she had handed over her original title documents relating to certain immovable property to Accused No. 1 in good faith. Subsequently, she came to know that Accused No. 1, in collusion with Accused Nos. 3 to 7, created false documents and misrepresented that she had sold the said property to Accused No. 2. 3
6.
Considering the nature of the transactions that were happened between the petitioner and L.W.1, and in view of the fact that L.Ws.1 and 2 have died, nothing survives in the calendar case to proceed further against the petitioner and the other accused. Continuation of the proceedings would amount to sheer wastage of judicial time, and the chances of conviction are bleak. 7. Accordingly, for the foregoing reasons, the Criminal Petition is allowed, and the proceedings in C.C.No.524 of 2018 on the file of the learned Judicial First Class Magistrate, Addanki, are hereby quashed. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y. LAKSHMANA RAO, J Date: 11.02.2026 KMS
