Being aggrieved by the order dated 21.08.2025, the 4 Petitioner filed revision i.e. CRR No.38/2025 before the learned Additional Sessions Judge, FTC (POCSO) Korba, District-Korba (C.G.) and vide order dated 07.11.2025, the learned Judge has dismissed the revision against which the present petition has been filed. 4. Learned counsel appearing for the Petitioner submits that the impugned order passed by both the Courts is a cryptic order as no proper reasons have been assigned for imposing the condition of depositing Rs.2,50,000/- in FD as security of the vehicle. He further submits that the petitioner is a poor person, who runs his family by driving the seized vehicle. Hence, it is prayed that the instant petition may be allowed, the orders dated 07.11.2025 and 21.08.2025 may be set aside and a smaller amount may be imposed for releasing of the seized vehicle in Supurdnama. 5. On the other hand learned Counsel appearing for the State opposes the argument advanced by learned Counsel for the Petitioner. 6. I have heard learned Counsel appearing for the Petitioner and perused the documents available on record. 7. Considering the facts and circumstances of the case also considering that the Petitioner is a poor person who runs his family by driving the vehicle, it is directed that in order dated 21.08.2025 passed by learned District Magistrate 5 Korba (C.G.) in case No.202411050400038/B-121/2024- 25, condition No. ‘3’ be omitted and condition No. ‘1’ be substituted as follows:- “1. The petitioner/custodian is directed to prepare a Fixed Deposit (FD) of 1,00,000/- (One Lakh Only) and submit it ₹ to the court in order to receive the seized Swaraj Mazda Super-4 vehicle bearing registration number CG-10 B.G. 8056 on a custody bond. 8. The rest of the conditions in order 21.08.2025 passed by learned District Magistrate Korba (C.G.) Case No.202411050400038/B-121/2024-25 shall remain intact. 9. In addition to the above modified conditions, it is also directed that the petitioner shall furnish Rs.7,00,000/- with one surety as Supurdnama in the concerned Court for releasing the vehicle in his favour as an interim custody keeping in view that there must not be any alteration in the physical appearance of the said article. It is also pertinent that the said vehicle shall be submitted by the Applicant itself on its own cost, if need so arises. 10. Accordingly, the instant petition is allowed to the extent indicated above. Sd/- (Sanjay Kumar Jaiswal) Judge Shubham
