1. Heard learned counsel for the parties.
2. The present writ petition has been filed for the following relief :-
“(a) for issuance of an appropriate Writ(s),
Order(s) or Direction(s) particularly Respondent No.2, the Circle Officer, Nagri to take proper and appropriate action upon the petitioner's application dated 08.04.2025 filed for demarcation of the land of the petitioner appertaining to Plot No.1337 and 1346, under Khata No.226, Mouza Pundag, Circle Nagri, Thana No.228 area ten (10) decimal of land within the district of Ranchi.”
3. The law is settled that the Circle Officer is merely a service provider and not an adjudicator. If there is any dispute, he is not supposed to make any measurement. Measurement cannot be made without reference point. It has to be started from the reference point at somewhere it is known as chand. Further, the consent of the neighbouring/ adjacent raiyat is required.
4. In view of above settled principle of law, the present writ petition is, hereby, disposed of directing the Circle Officer, Nagri, Ranchi to demarcate the land, as a service - 1 - W.P.(C) No.7658 of 2025
2026:JHHC:1449 provider only and only, if the adjacent raiyat has given consent and not otherwise. If there is any dispute, it can only be resolved by the competent civil court and not by the Circle Officer. The Circle Officer, Nagri, Ranchi, shall proceed in the matter, keeping in mind the above settled principle of law.
5. With above observations and directions, the present writ petition is, hereby, disposed of.
6. Pending interlocutory application, if any, also stands
disposed of.
