No. 5890737, for which reason the matter may be remanded for re-consideration by the Registrar. This course of action is acceptable to learned counsel for the appellant. Accordingly, the Registrar is directed to list the matter within the next 04 weeks and issue requisite notice to the parties. The Registrar is also directed to change the status of the trade mark in its records from ‘registered’ to ‘opposed’. The petition is disposed-of in the above terms.
