The present petition has been preferred by petitioner under Article 226 of the Constitution of India, being aggrieved by the installation of a petrol pump adjacent to the Technical School of petitioner -society, allegedly in violation of the norms prescribed by the Central Pollution Control Board (for short “CPCB”) as well as the Petroleum and Explosives Safety Organisation (for short “PESO”). 3. Learned counsel for the petitioner submits that an application dated 26.09.2025 (Annexure -P/1) has been submitted before the Additional Tehsildar, Bhilai, District Durg (CG), and a copy thereof was also been forwarded to the Municipal Corporation and the Collector, despite that, the grievance of the petitioner has not been redressed till date. Hence, learned counsel prays that this petition may be disposed of with a direction to respondent authorities to decide the aforesaid application (Annexure-P/1) filed by petitioner. 4. Learned State counsel submits that the application filed by petitioner shall be considered and decided in accordance with law and circulars issued by the competent authority. 5. Having considered the limited prayer of the petitioner, and instead of keeping the present petition pending, the same is disposed of by granting liberty to the petitioner to file a fresh application before respondent No.4-Collector, Durg, within a period of 15 days from today, along with the circular dated 09.09.2024 issued by the Petroleum and 3 Explosives Safety Organisation, as well as any circular issued by the Central Pollution Control Board, and a copy of this order, for redressal of its grievance. It is further directed that upon filing of such application by petitioner, the same shall be considered and decided by respondent No.4 -Collector, Durg, District Durg / competent authority, expeditiously, preferably within a further period of 60 days from the date of filing of the application. 6. With aforesaid observation and direction, this writ petition stands disposed of. 7. Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
