1. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.183/2025 registered at Police Station Dug, District Jhalwar for offences under Sections 16, 54 and 54(A) of Rajasthan Excise Act, 1950.
2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. [2026:RJ-JP:4395] (2 of 2) [CRLMB-1768/2026] allegation of committing organized crime but the necessary ingredients of continuing unlawful activity are conspicuously absent to constitute an offence under Section 111 BNS. None of the cases against Deewan Singh was reported as antecedent though one case has been reported against Ranjeet Singh as antecedent. Charge-sheet has already been filed. Petitioners are behind the bars since 02.01.2026. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody and the bail application of the petitioners may be allowed.
5. Learned Public Prosecutor has vehemently opposed the bail application.
6. On consideration of the rival submissions and material available on record and in light of submission made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.
7. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioners Deewan Singh S/o Bhagwan Singh and Ranjeet Singh S/o Shankar Singh, shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before the Court on all the dates till conclusion of the trial.
