By this application, the petitioner has sought for pre-arrest bail in connection with Dibrugarh Police Station Case No. 372/2025 registered under Page No.# 2/3 Sections 74/77/79 of the Bharatiya Nyaya Sanhita, 2023 along with Sections 66E-67/67A of the Information Technology Act, 2000. 3. The FIR dated 06.12.2025 lodged by the informant reveals that her private video had been uploaded on an adult website by some unknown miscreants. She also alleged that the same had been uploaded in six other pornographic websites and that she alleged that she suspects that those videos had been uploaded by the petitioner since she had a love relationship with him. 4. Mr. Das, learned counsel for the petitioner submits that the FIR has been lodged only on suspicion and the subject of the FIR states that it has been uploaded by some unknown miscreants. He also states that the petitioner on getting the knowledge of the FIR, lodged a complaint before the Police Officer of Bongaigaon Police Station that the suspicion was based on no evidence and he himself wants the truth to be unearthed. 5. Mr. Sarma, learned State counsel submits that while rejecting the prayer for bail, the Trial Court had gone through the Case Diary and incriminating materials were found against the petitioner. 6. On consideration of the submissions made by the parties, moreso of the fact that the petitioner was just suspected to have uploaded the video without any substantiating fact, this Court finds it fit that the petitioner be released on pre-arrest bail on furnishing a bail bond of Rs.20,000/- (Rupees Twenty Thousand) with one local surety of like amount to the satisfaction of the arresting authority under the following conditions :- (i) He will appear before the Investigating Officer within a period of 10 (ten) Page No.# 3/3 days from today. (ii) He shall not hamper with the evidence and influence the witnesses connected with this case. 7. Petition is disposed of. JUDGE Comparing Assistant
