Case No.293 of 2025 dated 13.08.2025 under Sections 109/117(2)/118(2)/126(2)/3(5)/303(2)/324 (4)/74 of the BNS. Parveen … for the de facto complainant Learned counsel for the petitioners submits that the wife of the petitioner No.1 and the mother of the petitioner No.2 had earlier made written complaints against the de facto complainant and his relations for threats meted out to them. Thereafter, the petitioners were badly assaulted by the de facto complainant and his associates. An FIR was registered. In the free fight, both sides suffered injuries. But, the injuries sustained by the present petitioners were grievous in nature. Learned counsel for the State opposes the prayer for anticipatory bail and submits that in the present case, there are three injured persons, one of whom is a lady who received grievous injuries. The statements of the witnesses including the victim implicate the present petitioners. 2 It appears from the statement of the victim recorded before the learned Magistrate that the blow which caused grievous injury was allegedly caused by the petitioner No.1. Considering the above, the other materials available in the case diary and the alleged role ascribed to each of the present petitioners, while I am inclined to grant anticipatory bail to the petitioner No.2, the application for anticipatory bail of the petitioner No.1 (Dr. Wajid Ali alias Yajid Ali alias Wajid Ali) is rejected. In the event of arrest, the petitioner No.2 (Yasif Ali alias Wasif Reza) shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner No. 2 shall cooperate with the investigation, shall meet the investigating officer once a week till submission of report in final form and shall not threaten or intimidate witnesses. The application for anticipatory bail is, thus, disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
