As submitted by the learned counsel appearing for the accused petitioner that a civil suit was filed jointly in the name of the accused petitioner and the complainant and further when the application for temporary injunction was rejected, a civil misc. appeal was also filed before the Competent Court so as to challenge the order of rejection of application for temporary injunction in the joint names. 7. On asking, the counsel appearing for the accused petitioner has placed before this Court the Vakalatnama of the Lawyer filed along-with the civil misc. appeal. It is found that the said Vakalatnama does not bear the signatures of the complainant and only the signatures of the accused petitioner are there on the Vakalatnama. Since the appeal was filed in the joint names, a memo of appearance was submitted for the complainant but in the memo of appearance also it has not been stated that whether the complainant has authorized to file this memo. 8. As per the investigation report, the certified copy of the memo of appeal was obtained which said to bear the signatures of the complainant. [2026:RJ-JP:2501] (8 of 10) [CRLMB-1118/2024] 9. The specimen signatures of the complainant were taken in the presence of the Gazette Officer and were sent for comparison with the signatures on the memo of appeal and in the report it has been found that the signatures on those documents do not resembles with the specimen signatures of the complainant which clearly shows that the forged signatures of the complainant have been put in the memo of appeal. 10. As per the factual report submitted by the learned Public Prosecutor, as many as 10 other criminal cases were registered against the accused petitioner and in one of the criminal case the accused petitioner has also been convicted vide judgment dated 19.02.2022 and in some of the cases the investigation is still pending. 11. The Court while considering the bail application vide order dated 31.01.2025 directed the petitioner to join the investigation and appear before the Investigating Officer on 10.02.2025 in between 10:00 AM to 5:00 PM. As per the factual report of the Investigating Officer the petitioner did not appear before the Investigating Officer on 10.02.2025 as directed by the Court. The accused petitioner approached the Investigating Officer on the next day when the Investigating Officer was to proceed for investigation of some other case. On 14.02.2025 the Court again allowed an opportunity to the petitioner to appear before the Investigating Officer on [2026:RJ-JP:2501] (9 of 10) [CRLMB-1118/2024] 21.02.2025 but on the said date the accused petitioner did not appear before the Investigating Officer and flouted the directions. Again, the Court vide order dated 12.05.2025 allowing another opportunity to the petitioner directing him to appear before the Investigating Officer on 23.05.2025 but the petitioner did not appear before the Investigating Officer on due date as ordered by the court. The Court vide order dated 02.07.2025 again directed the petitioner to appear before the Investigating Officer on 14.07.2025 at 11:00 AM but he flouted the orders and did not appear before the Investigating Officer. The Court vide order dated 27.10.2025 allowing one more opportunity to the petitioner, directed him to appear before the Investigating Officer on 30.10.2025 at 11:00 AM but on that date also he did not appear. 12. On 17.12.2025 though the petitioner is said to have appeared before the Investigating Officer but has not cooperated in the investigation so as to complete the investigation fairly. The aforesaid facts clearly show the conduct of the petitioner who is facing other cases of similar nature. 13. The allegation made against the accused petitioner is of preparing forged documents and also filing of appeal before the Civil Court with the forged signatures of the complainant which is corroborated by the report sought by the Investigating Officer as regards comparison of the [2026:RJ-JP:2501] (10 of 10) [CRLMB-1118/2024] signatures. In view of the conduct of the petitioner, as observed above, wherein he has not even due respect to the Court directions and also taking into consideration the fact that the accused involving the lawyers in the matter demands custodial interrogation of the accused petitioner so as to find out the truth as regards the allegations against him because the conduct of the petitioner shows that he is not going to cooperate the Investigating Officer in a proper manner, if he is extended the benefit of anticipatory bail. 14. 14. Taking into consideration the overall facts and circumstances of the case so also the nature of allegations leveled against the petitioner including his conduct and criminal antecedents, this Court is not inclined to grant concession of anticipatory bail to the accused petitioner. 15 Accordingly, the anticipatory bail application filed by the accused petitioner under section 438 CrPC is dismissed.
