B E F O R E HON’BLE MR. JUSTICE MICHAEL ZOTHANKHUMA ORDER
15.10.2026
Heard Mr. Zoramchhana, learned counsel for the applicant. Also heard Mr. Page No.# 4/5 Benjamin Lalthlamuana, learned counsel appearing for the respondent No. 1, Ms. Caroline K. Lungawipuii, learned counsel appearing for respondent No. 7 and Mr. Kartik Jain, learned counsel appears for respondent Nos. 8 to 11 as well as Ms. Zairemsangpuii, learned CGC appears for respondent No. 2.
This is an application for impleading the applicant, Smt. C. Lalrinchhani, W/o late Zoramliana as respondent No. 13,on the ground that the Competent Authority for land acquisition, (CALA), Aizawl had committed an error while passing the 3G Award dated 13.04.2025, by inserting the name of Smt. Zohmingthangi as one of the beneficiaries of the compensation to be given for acquisition of land for construction of the National Highway-6. The applicant's counsel submits that Smt. Zohmingthangi and her late husband Zoramliana are brothers and sisters, having adjacent lands. While the road alignment made by the respondents was to the effect that the road was to be constructed on the land of the applicant's late husband, Smt. Zohmingthangi has been named as the beneficiary of the compensation amount, though she is the owner of the adjacent land. He submits that the same is an error which can easily be corrected after verification by the concerned authorities. However, to claim her right to be given compensation, she needs to be impleaded as respondent No. 13,as she has inherited the property from her late husband, vide

While the counsels for respondent Nos. 2, 7 and 8 to 11, submit that they have got no objection to the impleadment application being allowed, Mr. Benjamin Lalthlamuana, counsel for the respondent No. 1 objects to the application being allowed. On considering the fact that the issue pertains to a factual dispute, as to whether the road alignment is to run over the land of the applicant or the land of Smt. Zohmingthangi, this Court is of the view that the applicant should be impleaded as a respondent. Accordingly, the applicant, Smt.C. Lalrinchhani(46), W/oZoramliana(L), R/o ITI Veng, Aizawl, Mizoram, is impleaded as respondent No. 13. Corrected copy of the cause title should be furnished to the Registry by the applicant's counsel. The IA is accordingly allowed and disposed of. • JUDGE Comparing Assistant
