By this petition, petitioner herein is seeking recall of the warrant dated 25th of May, 2026, issued by the learned court of Principal District and Sessions Judge, Baramulla in civil contempt petition titled ‘S. Prabhjit Singh Johar vs. S. Amarjit Singh Johar and Anr.’ 2. It is stated that there is a civil dispute going on between two brothers which involved an alleged violation of order of status quo passed in the year 2012 with regard to Hotel Johar in Gulmarg. Petitioner herein is about 85 years old, bed-ridden senior citizen, currently residing in Gurgaon, Delhi. He is suffering from multiple age-related ailments including Dementia and severe cardiac problems which makes it physically impossible for him to travel to Baramulla. It is further stated that petitioner had filed an application dated 12.06.2026, before the court of learned District Judge, Baramulla, seeking recall of the warrant and had also requested for permission to appear via video conferencing, however, the said application has not been decided. Learned Principal District Judge, Baramulla, on 25.05.2026, had issued warrant of arrest against the petitioner hrerein to be executed by Senior Superintendent of Police, Baramulla. 3. Learned counsel for the petitioner states that the limited prayer of the petitioner, who is an aged person is to the extent that he may be allowed to appear through virtual mode. 4. In the peculiar facts and circumstances of the case, the impugned order dated 25th of May, 2026 is set aside. The instant petition is disposed of with a direction to learned Principal District Judge, Baramulla, to allow the petitioner to appear through video-conferencing along with his wife and attendant. 5.
