1. The petitioner stands convicted in connection with FIR No. 48/2001, registered at Police Station Rajinder Nagar, for offences punishable under Sections 302, 186, 353 and 34 of the Indian Penal Code, 1860, and Section 25 of the Arms Act, 1959, and has been sentenced to life imprisonment. He has undergone more than 15 years of actual incarceration, in addition to over four years of remission. The grievance raised by the petitioner in the present petition under Article 226 of the Constitution pertains to his application seeking transfer to a semi-open jail.

3. Mr. Tyagi submits that applications of this nature are considered by the Selection Committee constituted under Rule 1320 of the Delhi Prison Rules, 2018. He further submits that the petitioner’s case could not be considered at the last meeting of the Committee as the petitioner was then on furlough and, consequently, was not available for interview. He states that the petitioner’s case shall be considered at the next meeting of the Committee, which is scheduled to be held within the next three months.
4. In view of the aforesaid submission, Mr. Anindya Malhotra,
learned counsel for the petitioner, submits that no further relief is sought at this stage.
5. The petition, alongwith the pending application, is accordingly
disposed of, binding the respondent to the aforesaid submission and without prejudice to the rights and remedies available to the petitioner.
6. A copy of this order be communicated to the concerned Jail Authorities for necessary information and compliance.
