The petitioner has filed this writ petition seeking following reliefs:- 3 “10.1 That this Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioners. 10.2 That this Hon'ble Court may kindly be pleased to direct the respondent authorities to consider the claim of petitioners for grant of remaining gratuity of the services rendered by the petitioners as daily wages employees under the respondent department, in the interest of justice. 10.3 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to consider and decide the representation of petitioners (Annexure P/5), in the interest of the justice. 10.4 That, any other relief which the Hon'ble Court may deemed fit and proper also be granted to the petitioners, in the interest of justice.” 2. Learned counsel for the Respondent/State raises an objection with regard to maintainability of the writ petition on the ground that the petitioner is having the alternate efficacious remedy of appeal before the controlling authority under the Payment of Gratuity Act, 1972. 3. After arguing for sometime, learned counsel for the petitioner submits that he may be permitted to withdraw this writ petition at this stage with liberty to avail the other remedy available under the law. 4. On due consideration of the submission of counsel for the respective parties, this writ petition is dismissed as withdrawn at this stage, reserving liberty with the petitioner to avail the alternate remedy available under the law. 5.
