Petitioner -- Versus -- The State of Jharkhand .... Opposite Party ---- CORAM: HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI --- For the Petitioner :- Mr. Arvind Kumar Choudhary, Advocate For the State :- Mr. Rajesh Kumar, Advocate ---- 2/11.06.2026 Heard learned counsels for petitioner and for State. 2. The petitioner is apprehending his arrest in connection with Mandar PS Case 153 of 2022, for offence registered under section 420, 409 and 34 of Indian Penal Code, pending in court of learned Judicial Magistrate-XII, Ranchi. 3. Learned counsel for petitioner submits that the petitioner happened to be the President of Village Education Committee. He next submits that the allegations are made that the amount was paid to construct the School building and after completion of the school building, a sum of Rs.4,10,141/- was required to be returned, however, the same was not returned and in view of that the FIR has been lodged. He next submits that, however, the Secretary of the School has returned the said amount and pursuant to that, the No Objection Certificate (NOC) has been issued by the Department by way of Annexure-2. He next submits that the petitioner has nothing to do with the said allegation and the amount has already been returned and in view of that anticipatory bail may kindly be granted. 2026:JHHC:16796 2 4. Learned State counsel opposes prayer and submits that the petitioner and the Secretary of the School were the authorized signatory to operate the Bank account and in view of that, the allegations are correct and as such, anticipatory bail may kindly be rejected. 5. Annexure-2 is the document which clearly suggest that the Secretary of the School has returned the said amount and pursuant to that the NOC has been issued by the Department and in view of the said NOC, it is proved that the amount has been returned and it further fortifies in light of the submission of the learned counsel for the respondent State, as he has pointed out that the petitioner and the Secretary of the School were responsible for operating the account jointly. Thus, the said amount has already been paid in light of the Annexure-2, and in the attending facts and circumstances of the instant case, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate-XII, Ranchi, in connection with Mandar PS Case 153 of 2022, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
