The petitioners are apprehending their arrest in connection with Muffasil P.S. Case No. 532 of 2025 for the offence under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 117(2), 109, 303(2), 352, 351(2) and 3(5) of the BNS. 3. As per the prosecution case, some land mafias grabbed the land of the informant and Motihari Muffasil P.S. Case No. 443 of 2025 was instituted against the petitioners and Patna High Court CR. MISC. No.22767 of 2026(3) dt.06-05-2026 2/3 other co-accused persons. The informant has further alleged that petitioners and other co-accused persons carried away construction materials like bars, sand, stone chips etc. worth Rs. 15-20 lakhs from the land of the informant. Thereafter, the informant, his family members and neighbours were assaulted by the petitioners and other co-accused persons. 4. Learned counsel for the petitioners submits that the petitioners are quite innocent and have not committed any offence, much less the offence alleged against them. It is contended that they have been falsely implicated in the present case on account of a dispute relating to a pathway over land. Both parties are neighbours and are involved in a long-standing land dispute. It is further submitted that, from a perusal of the F.I.R., it appears that the names of the petitioners appear only at the end thereof with general, vague, sweeping, and omnibus allegations, without attributing any specific overt act against them. Learned counsel further submits that similarly situated co- accused persons, namely, Mukesh Kumar Singh and Sant Kumar Prasad, have already been granted bail by a Co-ordinate Bench of this Court vide orders dated 10.04.2026 and 28.01.2026 passed in Cr. Misc. No. 21556 of 2026 and Cr. Misc. No. 553 of 2026 respectively. Patna High Court CR. MISC. No.22767 of 2026(3) dt.06-05-2026 3/3 5. Learned APP opposes the prayer for bail. 6. Keeping in view the aforesaid facts, this Court is inclined to extend them the privilege of anticipatory bail. 7. Let the petitioners be released on bail in the event of arrest or surrender within a period of four weeks from the date of receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Muffasil P.S. Case No. 532 of 2025 subject to the conditions as laid down under Section 482 of B.N.S.S., as also with the condition that one of the bailors should be close relative of the petitioner.
