Dhanraj S/o Shivraj, Aged About 22 Years, Resident Of Village Chandali, Police Station Sarwad, District Ajmer (Raj.) ( At Present Confined In Central Jail Ajmer) ----Petitioners Versus State Of Rajasthan, Through P.p. ----Respondent For Petitioner(s) : Mr. Ashvin Garg For Respondent(s) : Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 30/01/2026 1. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.338/2025 registered at Police Station Sarwar, District-Ajmer for offences under Sections 115(2), 126(2), 333, 189(2), 351(2), 351(3) and 74 of BNS. 2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. He further submits that only omnibus allegations have been levelled against the present petitioners, and no specific act has been attributed to them. He submits that petitioners and victim relates to same family and resides in same locality. Due to some civil dispute, this FIR has been lodged on the false and concocted grounds. Though there is allegation of causing injuries to injured Sheela, Udaram, [2026:RJ-JP:4416] (2 of 2) [CRLMB-1769/2026] Anju, Ganna and Kanaram but from the perusal of the injury report it reveals that all the injuries are simple in nature and none of the injuries have been opined to be dangerous to life by the medical expert. Co-accused-Kailash has been enlarged on bail by this Court on 23.01.2026. Though one case has been reported against both the petitioners but they have been granted bail in that case. Charge-sheet has been filed. Petitioners are behind the bars since 17.12.2025. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody and the bail application of the petitioners may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, and without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioners-Devraj S/o Kailash Chand and Dhanraj S/o Shivraj shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/ each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
