Versus The State of Jharkhand … Opposite Party
------
CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY
------
For the Petitioner : Mr. Indrajit Sinha, Advocate
: Mr. Shivam U. Sahay, Advocate
: Mr. Manmohit Bhalla, Advocate For the State
: Mr. V.K. Vashistha, Spl. P.P. ------
Order No.05 Dated- 11.06.2026
Heard the parties.
The petitioner has moved this Court for grant of bail in connection with N.D.P.S. Case No. 51 of 2024 arising out of Arki P.S. Case No.37 of 2024 registered for the offences punishable under sections 8(c)/18/21(c)/22/25 of N.D.P.S. Act.
This is the third journey of the petitioner with the prayer for regular bail and earlier the prayer for regular bail of the petitioner was rejected twice. It is submitted by the learned counsel for the petitioner that the fresh ground is that in the meanwhile the petitioner has been in custody for some more time. It is then submitted allegations against the petitioner are all false. Hence, it is submitted that the petitioner be admitted to bail.
The learned Spl. P.P. on the other hand vehemently opposes the prayer for bail and submits that merely because the petitioner has been in custody for some more days is not a sufficient ground to reconsider the prayer for regular bail when the opium in commercial quantity was involved in this case and there is no justifiable reason to record any satisfaction in terms of Section 37 of N.D.P.S. Act. Hence, it is submitted that the petitioner ought not to be admitted to bail.
Considering the serious nature of allegation against the petitioner, this Court is of the considered view that this is not a fit case where the abovenamed petitioner be admitted to bail. Accordingly, the prayer for bail of the abovenamed petitioner is rejected for the same reasons as mentioned in the orders dated 12.02.2025 and 19.09.2025 in B.A. Nos. 1136 of 2025 and 8788 of 2025 respectively.
