That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to post the petitioner his original place of posting i.e. Government Higher Secondary School Kothari, Block Kartala, District Korba in place of the office of District Education Officer, Rajnandgaon or at the vacancy for which has been enlisted at Serial No.34 Government Higher Secondary School Kanki in District Korba in the letter dated 22/12/2025 (Annexure P/8) 10.3. That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to grant the petitioner the suspension allowance. 10.4.That, this Hon’ble Court may kindly be pleased to grant any other writ/writs, order/orders, relief/reliefs, in favour of the petitioners, which the Hon’ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioners. 2. Learned counsel for petitioner submits that petitioner while working on the post of Lecturer at Government Higher Secondary School Tuman, District Korba, has been promoted to the post of Principal vide order dated 2.9.2013 and posted in Government High School Chachiya, District Korba. Vide order dated 30.7.2016, petitioner has been transferred and posted at Government Higher Secondary School Kothari, Block Kartala, District Korba. While working as Principal in aforementioned school, petitioner was placed under suspension vide order dated 16.10.2024. After submission of 3 reply to show-cause notice, respondent authorities have taken a decision for inflicting penalty of withholding of one annual increment with non-cumulative effect upon petitioner under Rule 10 (iv) of the Civil Services (Classification, Control and Appeal) Rules, 1966 and thereby order of suspension is revoked. Thereafter, petitioner was posted at the option of District Education Officer, Rajnandgaon and pursuant thereto, petitioner gave his joining, however, petitioner was informed by the District Education Officer that as there is no school of T-Cadre within District Rajnandgaon, therefore, he cannot be given posting. The District Education Officer also wrote letter to respondent No.3-Director, Directorate of Public Instructions, Naya Raipur on 1.1.2026 informing about the said aspect. He submits that though petitioner has given joining in compliance of the order of the competent authority, however, he is not posted in any school for the reason as assigned by the District Education Officer. Further, the respondent No.3 has also not taken any decision on the letter of the District Education Officer dated 1.1.2026. Therefore, a direction be issued to respondent No.3 to take decision on the letter written by the District Education Officer, Rajnandgaon dated 1.1.2026 and to post the petitioner at appropriate place. He also submits that even the post of Principal is lying vacant in District Korba. 4 3. Learned State Counsel submits that in view of documents annexed along with writ petition, in particular letter of the District Education Officer dated 1.1.2026 and submission made by learned counsel for petitioner that a direction be issued to respondent No.3 to take decision with respect to posting of petitioner at appropriate place, he is having no objection if this writ petition is disposed issuing such a direction to respondent No.3. 4. On due consideration of submission of learned counsel for respective parties and considering that decision with respect to posting of petitioner, who is holding post of Principal, is to be taken at the end of respondent No.3, therefore, without expressing any opinion on claim of petitioner, this writ petition is disposed of at this stage directing respondent No.3 to take decision on the letter of the District Education Officer, Rajnandgaon dated 01.01.2026 in accordance with law expeditiously, preferably within a period of two weeks from the date of receipt of the order. 5.
