The instant bail application has been filed under Section 483 of the BNSS, 2023 on behalf of accused-petitioner in connection with FIR No.232/2023 registered at Police Station Jhotwara, Jaipur (West) for the offence under Sections 420, 406 & 120-B IPC, Sections 4, 5 & 6 of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978 and Section 21(3) of the Irregular Deposit Scheme Prohibition Act, 2019. 2. Heard. 3. Considered. 4. It is submitted by counsel for the petitioner that the accused-petitioner is languishing in jail since 08.11.2023 and even after passing of near about 35 months only 2 witnesses out of total 9 prosecution witnesses have been examined so far. It is [2026:RJ-JP:4572] (2 of 2) [CRLMB-1658/2026] further submitted that the allegation in this case is that the firm has cheated some persons where the accused-petitioner is working as an agent. 5. Learned Public Prosecutor vehemently opposed the bail application and states that this is a case of cheating of around 200 crore. 6. The accused-petitioner is in custody since 08.11.2023 and out of 9 prosecution witnesses only 2 have been examined so far. It seems that trial of the case will take further considerable time and the accused-petitioner cannot be kept in custody for indefinite period without there being any fault on his part and he is having right of speedy trial. 7. Taking into consideration overall facts and circumstances of the case that the accused-petitioner is in custody since 08.11.2023, this Court without expressing any opinion on the merits/demerits of the case deems just and proper to enlarge the accused-petitioner on bail. 8. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner named above shall be enlarged on bail provided, he furnishes a personal bond in the sum of Rs.1,00,000/- together with two sureties of Rs.50,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
