The present petition under Section 528 of BNSS has been filed by the applicant for restoration of CRR No.524/2022, which was dismissed as having become infructuous vide order dated 29.07.2025. 2. Learned counsel for the applicant submits that the present CRMP No. 285/2026 has been filed seeking recall of the order dated RAHUL DEWANGAN Digitally signed by RAHUL DEWANGAN 2 29.07.2025 passed in CRR No. 524/2022. It is submitted that during the hearing of the revision petition, learned counsel for the respondents stated that both the parties had remarried and were living separately, and due to lack of proper communication with the applicant, learned counsel for the applicant inadvertently submitted that the matter had become infructuous. On the basis of such mistaken submission, this Hon’ble Court was passed the order dated 29.07.2025 dismissing the revision petition as having become infructuous. 3. For the reasons mentioned in the application, same is allowed and CRR No.524/2022, which was dismissed as having become infructuous on 29.07.2025 is restored in its original number. 4.
