JUSTICE S VISHWAJITH SHETTY ORAL ORDER This writ petition under Articles 226 and 227 of the Constitution of India is filed seeking for the following reasons: " a) Issue a Writ of Certiorari quashing the impugned notice dated 31-03-2026 ¸ÀASÉå: ªÀiÁAiÉÆÃ¥Áæ/vÀPÀgÁgÀÄ/J¯ïJN/32/2024-25/1224 issued by - 3 - HC-KAR NC: 2026:KHC:24674 WP No. 14827 of 2026 Respondent No.2/Magadi Planning authority which is produced as Annexure W. b) Issue a Writ of Mandamus restraining the Respondent No.2 from Cancelling the sanctioned plan by taking any coercive action against the petitioner, on the basis of impugned notice dated 31-03-2026 ¸ÀASÉå: ªÀiÁAiÉÆÃ¥Áæ/vÀPÀgÁgÀÄ/J¯ïJN/32/2024-25/1224 which is produced, as Annexure -W. c) To appoint the 4th respondent/ADLR, Bengaluru south, to ascertain whether the road allegedly claimed by the 3rd respondent exists. d) Grant such other relief/s as this Hon'ble Court deem fit to grant in the facts and circumstances of the case." 2. Heard Sri Vivek S. Reddy, learned Senior Counsel appearing for Sri Pradeep J.S., learned counsel for the petitioner and Smt.Spoorti V., learned High Court Government Pleader on behalf of respondent Nos.1 and 4. 3. The learned Senior Counsel for the petitioner submits that the complaint received from the private respondent is with regard to easementary rights over the property bearing Sy.Nos.153/4 and 153/5. He submits that the petitioner has been granted sanction plan to form a layout in an area measuring 69 Acres 30 guntas in Sy.Nos.141/8, 150/2A9, 151/6, 151/12, 151/13 and etc., situated at Tavarekere Village and Hobli, Bengaluru South Taluk. He submits that the survey - 4 - HC-KAR NC: 2026:KHC:24674 WP No. 14827 of 2026 sketch and Hudbust of the aforesaid land is subject matter of Appeal No.1/2023-24, which is pending consideration before the Assistant Director of Land Records, and till disposal of the said appeal, no further action can be taken pursuant to the impugned show cause notice. 4. Per contra, learned High Court Government Pleader submits that the petitioner has questioned the impugned show cause notice at Annexure-W dated 31.03.2026, instead of filing a suitable reply to the same. She submits that it is for the petitioner to raise all such contentions in its reply to the show cause, which will be considered in accordance with law and accordingly, she prays to dismiss the writ petition. 5. Notice at Annexure-W dated 31.03.2026 which is questioned in this writ petition, is only a show cause notice. Considering the nature of allegations found in the said show cause notice, I am of the opinion that it is for the petitioner to submit a suitable reply to the said show cause notice before the Authority who has issued the same. - 5 - HC-KAR NC: 2026:KHC:24674 WP No. 14827 of 2026 6. It is not the case of the petitioner that the impugned show cause notice is issued by an Authority who has no jurisdiction. Under the circumstances, I am of the opinion that the writ petition cannot be entertained. 7. Accordingly, the following: ORDER (i) The Writ Petition is disposed of, permitting the petitioner to submit its Reply/explanation to the impugned show cause notice at Annexure-W dated 31.03.2026, within a period of four weeks from the date of receipt of copy of this order. (ii) In the event the petitioner submits such a Reply/explanation to the show cause notice dated 31.03.2026, the concerned Authority shall consider the same in accordance with law, after giving an opportunity of hearing to the petitioner. Further, in the event any adverse order is passed as against the petitioner by the competent Authority, such an order shall not be given effect to, for a period of four weeks - 6 - HC-KAR NC: 2026:KHC:24674 WP No. 14827 of 2026 thereafter, so as to enable the petitioner to question the same, in accordance with law.
