p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.1313 of 2026 Jaga Naik … Petitioner Mr. A. Tripathy, Advocate -versus- State of Orissa … Opposite Party Mr. P. Satpathy, Addl. PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL):11.05.2026 03. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Banarpal PS Case No.72 of 2011 corresponding to CT(S) Case No.247 of 2024 pending in the file of learned Additional Sessions Judge, Angul, for commission of offences punishable U/Ss.364/302/201/ 34 of IPC, on the main allegation of kidnapping the deceased Basanta Naik and committing his murder, along with co-accused persons. 3. Heard, Mr. Asutosh Tripathy, learned counsel appearing virtually for the petitioner and Mr. P. Satpathy, learned Additional Public Prosecutor in the matter and perused the record. 4. After having considered the rival submissions upon perusal of record, it appears that the informant has alleged against the present petitioner for kidnapping the deceased and committing his murder by assaulting him with co-accused persons, however, the p. 2 informant is yet to be examined. Besides, the IO submitted charge-sheet by showing the present petitioner as an absconder. Further, the FIR was lodged on 04.05.2011 and charge-sheet was submitted on 31.08.2011, but the petitioner was apprehended after long gap. In the aforesaid facts and circumstance and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis the allegation sought to be brought against him and regard being had to the materials placed on record together with the evidence of PW2, this Court is not inclined to grant bail to the petitioner. 5. Hence, the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A copy of this order be immediately transmitted to the learned Court in seisin over the matter. (G. Satapathy) Judge Subhasmita
