In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Bongaon Police Station case no. 316 of 2025 dated 04.04.2025 under Sections 223/303(2)/317(2) of the Bharatiya Nyaya Sanhita, 2023 and 14(A)(b) of the Foreigners Act. Learned advocate appearing for the petitioner submits that petitioner is a lady having four children and has been implicated in connection with the present case for alleged offences under the BNS and Foreigners Act. Learned advocate for the State submits that petitioner was intercepted when she was trying to cross the Indian Border from the Indian side. No documents till date have been collected by the investigating agency to substantiate that she is a national from Bangladesh. There are documents which have been sent for verification which includes the Epic Card and Aadhaar Card. A photostat copy of the Passport has also been enclosed along with the bail application. Having considered that no documentary evidence is available or any authority of Bangladesh has supported the claim or there are
2 overwhelming materials to suggest that the petitioner is a foreign national, I am of the view that further detention of the petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed. Accordingly, petitioner namely, Khadija Sk Bibi @ Khadija Sk @ Khadija Munsi shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned A.C.J.M. Bongaon, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case and shall not leave the jurisdiction of district of North 24 Parganas without the prior permission of the learned Court. Accordingly, the prayer for bail in CRM (NDPS) 2669 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
