PS.ABOI IN THE DISTRICT OF MON NAGALAND - 798625 ------------ Advocate for : M NAOPHE KONYAK Advocate for : appearing for MOPA KONYAK AND ANR BEFORE HONBLE MR JUSTICE NCHUMBEMO MOZHUI O R D E R 13.10.2026 Heard Mr. Gautam Chaudhury, learned Senior counsel assisted by Mr. Medo Vero, learned counsel for the Applicant as well as Mr. Y.P. Gupta, learned counsel for Opposite Party Nos. 1 and 2. 2. By filing the instant application U/s 114 of the CPC, the Applicant/Petitioner seeks for recall/review of the Order dated 01.06.2026, passed in I.A.(Civil)/117/2026. 3. While preferring the main appeal, MFA/1/2026, the Applicant/Petitioner had filed I.A.(Civil)/117/2026 praying for grant of interim injunction/ad interim injunction of the impugned Order dated 27.03.2026. Page No.# 3/4 4. It has been pointed out by the learned Senior counsel for the Applicant/Petitioner that by Order dated 01.06.2026 in MFA/1/2026, this hon’ble Court was pleased to grant interim injunction till the next returnable date. However, this hon’ble Court, by Order dated 01.06.2026 in I.A.(Civil)/117/2026, while passing the interim injunction had disposed of the interlocutory application which ought not to have been passed in view of the fact that the interim injunction was till the next returnable date only. However, due to oversight, the interlocutory application was disposed. 5. It is the submission of the learned Senior counsel for the Applicant/Petitioner that if the Order dated 01.06.2026, passed in I.A. (Civil)/117/2026 is not recalled/reviewed prejudice will be caused to the Applicant. 6. This Court has taken consideration of the Records placed today and on perusal it has been found that though the interim injunction was passed in the main MFA/1/2026 which was extended till the next returnable date, this Court has inadvertently disposed the I.A. (Civil)/117/2026 which ought not to have been passed because of the fact that the interim injunction flows from the I.A.(Civil)/117/2026. 7. The learned counsel for Respondent Nos. 1 and 2, Mr. Y.P. Gupta have no objection to the effect that it is purely an error on the part of the Court insofar as it relates to the disposal of the I.A.(Civil)/117/2026. 8. Accordingly, the Order dated 01.06.2026 passed in Page No.# 4/4 I.A.(Civil)/117/2026 is recalled and the interlocutory application is kept open. 9. With the above, I.A. stands disposed of.
