Heard the learned counsel appearing for the respective sides.
In this writ application, the petitioner has prayed for quashing of the entire criminal proceeding in connection with Burmamines P.S. Case No. 46 of 2022, registered against the respondent No. 2 u/s 366A I.P.C. and further to declare the marriage of the petitioner with the respondent No. 2 as legal and valid.
It has been submitted by the learned counsel for the petitioner that after the case was instituted, the petitioner has solemnized marriage with the respondent No. 4 and two children have been born to them. It has been submitted that the case was instituted by the father of the petitioner and in view of the subsequent developments the entire criminal proceedings as against the respondents No. 2 to 3 deserves to be quashed and set aside.
Learned Sr. S.C.-II has opposed the prayer made in this application and has submitted that the petitioner was admittedly a minor at the time of the marriage.
It appears that an affidavit has been brought on record signed by the petitioner in which she has categorically stated at the time of incident she was a minor, but had subsequently attained majority and had thereafter solemnized marriage with the respondent No. 2.
Regard being had to the nature of allegations levelled against the respondent No. 2 and the fact that the petitioner was admittedly a minor at the time of the incident, I am not inclined to entertain this application which accordingly stands dismissed.
