The present petition has been filed by the petitioner under section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’) seeking quashing of FIR No. 210/2022, registered at Police Station Samaipur Badli, Delhi, for the offences punishable under Sections 308 of Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom on the basis of the settlement This is a digitally signed order. arrived at between the parties. 4. Issue notice. The learned APP accepts notice on behalf of the State. 5. The petitioner and respondent no. 2 are present before this Court and have been identified by the Investigating Officer. 6. Briefly stated, the present FIR was registered pursuant to an incident which allegedly took place on 20.02.2022 at the MCD Primary School Ground, Village Badli, Delhi, following an earlier altercation between the petitioner and the injured, Respondent No. 2. It was alleged that when the complainant and Respondent No. 2 met the petitioner to amicably resolve the earlier dispute, an altercation ensued, during which the petitioner allegedly assaulted Respondent No. 2 on his head with a cricket bat, causing injuries. On the basis of the complaint, FIR No. 210/2022 was registered at Police Station Samaipur Badli under Section 308 IPC. During investigation, the statements of the complainant, injured and other witnesses were recorded and a chargesheet was filed against the petitioner and criminal proceedings are pending before the learned Trial Court.
During the pendency of the proceedings, the parties, with the intervention of common friends, family members and respectable members of society, amicably resolved their disputes and executed a Memorandum of Understanding-cum-Settlement Agreement dated 14.07.2026. 7. On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that he has entered into compromise, vide Settlement Agreement dated 14.07.2026, out of his own free will and without any pressure, coercion or threat. Therefore, he has no objection if the present FIR is quashed. 8. In view of the above, that the parties have amicably resolved their This is a digitally signed order. differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9. Accordingly, FIR No. 210/2022, registered at Police Station Samaipur Badli, Delhi, for the offences punishable under Section 308 of the IPC along with all consequential proceedings emanating therefrom, is hereby quashed. 10. The present petition is disposed of. 11. Pending application(s), if any, also stand(s) disposed of. 12. Copy of the order be sent to the learned Trial Court for necessary information and compliance. 13. The order be uploaded on the website forthwith.
